Any injury or illness arising out of work is covered by workers’ compensation. The following are a few examples.

TRAUMATIC ACCIDENTS
These are serious one-time incidents that produce a significant injury, including lifting accidents, falls, blunt force trauma and motor vehicle accidents. Injuries often include herniated discs, bulging discs, rotator cuff tears, meniscal and ACL tears, fractures, or concussions.

REPETITIVE MOTION INJURIES
These injuries occur when an employee performs a given task over and over for an extended period of time.  They include carpal tunnel syndrome, cubital tunnel syndrome, epicondylitis, and tendonitis, to name a few.

OCCUPATIONAL EXPOSURES
When an employee is exposed to loud noises, chemicals, environmental contaminants, carcinogens such as asbestos or other hazardous substances, he or she may develop occupational diseases such as hearing loss, asthma, obstructive lung disease, mesothelioma, or other forms of cancer.

YOUR RIGHTS

If you have been injured or sick as a result of a work-related accident, condition, or stress, you have important rights.

MEDICAL TREATMENT & TEMPORARY BENEFITS

If you have suffered a work-related injury or illness, your employer is required to provide you with curative treatment including surgery, if necessary, and pay you temporary disability benefits at 70% of your wages until the treating doctor releases you back to work.

PARTIAL DISABILITY
In almost all cases, you will be entitled to a monetary award referred to as partial permanent disability after you return to work.  Employers and insurance companies will never tell you about your right to pursue this award.

TOTAL DISABILITY
When as a result of your work injury or illness, you are unable to return to the workforce, the New Jersey Workers’ Compensation laws require your employer to pay you weekly benefits for the remainder of your natural life.

I grew up in Deal, reside in Toms River, and received a law degree from Harvard, the nation’s top rated law school. I have been practicing exclusively in the workers’ compensation field for 15 years and received my training from Richard Kushinsky, a former supervising judge of compensation in Atlantic and Ocean Counties and one the most-highly regarded attorneys in the State.
